ATTN IHSS CAREGIVERS: LEARN HOW TO FILL OUT YOUR NEW IHSS TIMESHEETS TO HELP AVOID PAYCHECK DELAYS

On December 31st a Washington, DC judge ruled to put a temporary hold on the federal government’s right to enforce its new rule requiring that home care providers have the same right to overtime pay as all other workers. This hold is in effect until the courts will have another hearing on the matter.

Although each state has the right to decide whether to go forward with plans to pay overtime to home care workers, the California Department of Social Services has decided to abide by the temporary hold - meaning that California IHSS workers will not receive overtime, wait time or travel time payments until further notice.

IMPACT ON IHSS TIMESHEETS

Even though California is honoring the temporary hold on the requirement to pay overtime, wait time and travel time, the State will still be sending out the new IHSS timesheets.  Although qualifying IHSS providers will not receive payment for travel time due to the hold, it will be good to keep track of the time in a separate journal in the event that we’re able to win retroactive pay for that time in the future.
